Following the ruling of the 27th of July 2016, the Supreme Administrative Court determined that there is serious doubt regarding the legality of an administrative decision prohibiting the commercialization of whole insects for human consumption since the regulation of the 27th January 1997 “novel food” applies only to “food ingredients isolated from animals. “
Therefore, the Administrative Supreme Court considered that the interim relief judge of the Paris Administrative Court was right to have suspended the execution of a prefectural order prohibiting a company’s commercialization of whole insects and ordering the withdrawal of its products.
